Common Law on the outer.

Iwas reading with much amusement in todays paper about the States Atty General wanting to ditch some of the ancient common law rulings, before the expected influx of 1 million people crowd into the southern part of Queensland in the next few years. Laws such as trimming an over hanging branch and throwing back into your neighbors yard, and in situations such as the one i had and a new one i have, will be forced to make their way to the courts. I had/have a neighbor from hell who owns the house behind mine. For years and years and years, i begged him to cut a poinciana tree down that he'd planted right on the back fence line. It's whole canopy covered the entire back half of my house, and it had giant seed pods that would crash down on the roof (the back part of my home has 2 bedrooms and a bathroom and a rumpus room) and wake "A" in the middle of the night, the possums used it as a playground and would jump on to the roof too. Not to mention the fact that the roots were in my yard and starting to penatrate the concrete slab of the garden shed. This went on year after year, till we were hit with a huge cyclone. Well, the tree was so brittle, it lost many many branches, the back half of the house was covered (until we swept it all off the roof and into the weasels yard). I thought yippeeeeeeee, finally Barry the scumbag will trim the tree...................NOPE. Again i asked, again i got a smart arse answer. So i thought, fine, i will write you a letter of demand, just like any good solicitor would do, and scare you into trimming the tree. NOPE....nothing.....straight away anyhow. After discussions about him going to mediation with me, him not turning up i decided thats it.......we're going to court. Heh.......not too long after, the weasel trimmed the tree, infact removed the whole tree entirely!
Unfortunatelt i have the same problem with a neighbor to the side of my house. They have a huge fig tree, so big infact the leaves are found in about 5 properties that surround it. Anyhow, again it's causing problems for my place. Have asked the people to consider trimming it........nope..........asked and asked....nope nope....................now i am on to my next move.
Why are people so beligerant? I consider my neighbors, with everything in my yard. It would save so much court time if the council had the balls to enforce people not to have huge trees in their backyards. I know they cost thousands to trim, but for goodness sake, so should they, so consider it when buying a house.
