Litigation in Australia is becoming as crazy and lucrative as it is in the States. The list of "lunatic lawsuits" is gathering momento. One of my favorites is the one where a couple sued the owners of a close business claiming that noise,vibrations and dust had encroached on their home,so be it "trespassing"!! Surprisingly, a jury found in favor of the plaintiffs, but in a Court of Appeal it was quickly overturned. It was found that dust,noise and vibrations are not tangible obects therefore cannot trespass. (www.mlaw.org)
