AN 11-year-old boy carefully planned an armed robbery by casing out the service station and even dumping his toy gun in a creek afterwards, the court heard yesterday.Magistrate expressed "great concern" at the boy's age, given he was charged with such an "adult crime" carrying a 20-year jail sentence.
The boy was out on bail and had a 5pm curfew. Doesn't he sound like a charmer? I wonder where the parental control is here?
The court heard he was expelled recently from school and was known to police for past offences.
It is a very adult crime for someone so young.
He had the presence of mind to throw the toy pistol into the water.
A police statement said the boy armed himself with a cap gun and waited until no customers were in the store.
Using both hands, he allegedly pointed his weapon at the female attendant and demanded four packets of cigarettes and a lighter.
"If you call the cops I'll be back," the boy allegedly said as he fled. The court heard that the boy pointed his toy gun at two witnesses who attempted to apprehend him.
He then took off on a mountain bike, dumped his gun in a Creek and hid the cigarettes and lighter in bushland.
A short time later he was arrested and allegedly admitted the robbery.
The boys family were not in court.
The boy suffered attention deficit hyperactivity disorder and oppositional defiance disorder. He was not taking medication.
The boy sat staring straight ahead and yawned and stretched repeatedly during his court appearance.
Prosecutor said police were yet to recover the toy gun but still had a strong case against the boy.
The boy was not required to enter a plea to charges of robbery armed with an offensive weapon, using an offensive weapon to prevent lawful detention and three counts of common assault.
Bail was refused and the matter adjourned to August 22.
This matter won't be heard for ages but when it does i will inform you of the outcome.
